1. Introduction
These Terms of Service ("Terms") govern your use of the Guestii platform operated by GUESTI PTY LTD (ABN: 60 685 887 094) ("Guestii", "we", "us", "our").
Guestii includes:
- Guestii, a front-of-house event operations platform
- Guest Line, a promoter, venue and attendee platform
By using the platform, you agree to these Terms.
Venues, organisers and promoters who operate events through the Guestii platform are also subject to the Organiser Agreement, which sets out additional obligations relating to Guest Data, re-invitation, team access and fees.
2. Who these Terms apply to
These Terms apply to all users, including:
- Guests (event attendees)
- Promoters and hosts
- Venue operators and staff
- Contractors and event workers
Different parts of the platform apply depending on your role.
3. Nature of the platform
Guestii is an event operations, ticketing and coordination platform.
Guestii:
- Enables the creation and sale of tickets to events
- Manages guestlists, entry and access control
- Provides promoter tools and attribution
- Facilitates event-related payments
Guestii acts as a technology platform connecting attendees with venues and organisers.
Guestii is not the organiser of events and does not control how events are run.
Venues and organisers remain solely responsible for their events.
4. Accounts
You may be required to create an account.
You agree that:
- Information you provide is accurate
- You are responsible for your account activity
- You will not share access or misuse the platform
We may suspend or terminate accounts where misuse is identified.
5. Tickets, guestlists and entry
Guestii may issue:
- Paid tickets
- Guestlist access
- QR-based entry passes
5.1 Tickets
Where tickets are purchased through the platform:
- A ticket represents a right to attend an event, subject to the organiser's terms
- Entry may be subject to venue rules, capacity limits and conditions
- Tickets may include time-based or conditional entry
5.2 Guestlists
Guestlist access:
- Is not a paid ticket unless explicitly stated
- Does not guarantee entry
- Remains subject to venue discretion
5.3 Venue discretion
Venues may:
- Refuse entry
- Remove guests
- Enforce dress codes or behaviour standards
Guestii is not responsible for these decisions.
6. Events and content
Venues, organisers and promoters are responsible for:
- Event details
- Guestlist approvals
- Entry conditions
- Event delivery
Guestii does not verify or guarantee event accuracy.
7. Payments and ticketing
Payments are processed via Square using the venue or organiser's own payment account.
7.1 Role of Guestii
Guestii provides the infrastructure for ticket sales and payment collection.
Guestii:
- Does not act as the merchant of record
- Does not hold or control customer funds
- Does not operate a stored value or wallet system
All payments are processed directly between the customer and the relevant venue or organiser.
7.2 Venue responsibility for payments
The venue or organiser is solely responsible for:
- Payment processing (in conjunction with Square or another supported payment provider);
- Settlement of funds;
- Handling payment disputes and chargebacks;
- Refund decisions and refund policies.
Where Guestii provides online ticketing functionality, Guestii may operationally process refunds to a buyer on the venue or organiser's instruction. Guestii does not decide whether a refund is owed, does not hold or control buyer funds, and is not the merchant of record.
Guestii is not a party to the transaction between the customer and the venue or organiser.
8. Refunds, cancellations and disputes
8.1 Event responsibility
All events are organised and operated by venues or organisers.
They are responsible for:
- Event delivery
- Changes, delays or cancellations
- Entry policies and conditions
8.2 Refunds
Refund eligibility and refund decisions are determined by the venue or organiser, subject to applicable law (including the Australian Consumer Law).
Guestlist requests are free; no fee is charged and no refund is required.
For paid at-door entries: where entry has been granted, the entry has been delivered and is not refundable through Guestii.
For paid online tickets, where Guestii provides online ticketing functionality, Guestii may process refunds to the buyer on the venue or organiser's instruction. In all cases:
- Guestii does not decide whether a refund is owed;
- Guestii does not hold buyer funds - these remain with the venue or organiser's payment provider;
- Guestii is not the merchant of record.
8.3 Consumer law
Nothing in these Terms excludes rights under Australian Consumer Law.
Where required by law, venues and organisers must provide refunds or remedies.
8.4 Chargebacks and disputes
Any payment disputes or chargebacks must be handled by the venue or organiser through their payment provider.
Guestii may:
- Provide transaction data to assist investigations
- Suspend or restrict accounts involved in suspected fraud or misuse
9. Promoters, commissions and tax
Guest Line enables promoters to participate in campaigns and earn commissions based on event performance.
Promoters operate independently and are not employees, agents or representatives of Guestii.
9.1 Payments and responsibility
Unless explicitly stated otherwise, commission payments are made by the relevant venue or organiser, not by Guestii.
Guestii may facilitate the calculation or reporting of commissions but does not act as the payer.
9.2 Tax, superannuation and withholding
Promoters are responsible for their own tax affairs, including any income tax, GST, superannuation or other obligations that may arise.
Venues and organisers are responsible for complying with any applicable tax, withholding or reporting obligations.
Guestii does not:
- Withhold tax
- Make superannuation contributions
- Provide tax advice
- Assume responsibility for tax or employment obligations
9.3 Independent advice
Promoters, venues and organisers should seek independent financial, tax or legal advice where required.
10. Data and platform use
Users agree not to:
- Copy or scrape data
- Attempt to access unauthorised information
- Misuse guest or venue data
- Reverse engineer the platform
Access to data is limited to what is necessary for your role.
11. Data ownership and use
11.1 Roles
Where Guestii processes guest, attendee or event data on behalf of a venue, organiser or promoter (an "Organiser"), the Organiser is the data controller and Guestii acts as a data processor.
- The Organiser owns the event and attendee data submitted through the platform in connection with their events.
- Guestii holds a limited licence to use that data only to operate, secure and improve the platform and to deliver the services the Organiser has contracted for.
- Guests retain rights to their personal information under the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
11.2 Marketing and re-invitation
When a guest requests access to an event through the Guestii platform (for example, via the slide-to-request flow on Guest Line), the guest acknowledges and reasonably expects that the Organiser may use those details to send invitations and updates about future events through the Guestii platform.
This expectation is presented to the guest at the point of request within the platform.
The platform's built-in re-invitation feature is the only communication channel Guestii facilitates on behalf of the Organiser within the platform. Guestii does not send general marketing on behalf of an Organiser.
Where an Organiser uses guest data externally (including via their own email service, SMS provider, CRM, social media custom audiences or any other third-party marketing tool), the Organiser is solely responsible for:
- Maintaining a valid lawful basis and consent under the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and any equivalent laws applicable to the recipient;
- Including sender identification and a working unsubscribe mechanism in every commercial electronic message;
- Honouring unsubscribe requests within the timeframes required by law;
- The accuracy, lawfulness and content of any external marketing communication.
Guestii is not a party to and is not responsible for any marketing or communications an Organiser sends outside the Guestii platform.
11.3 De-identified and aggregated data
Guestii may use aggregated and de-identified data - including platform-wide benchmarks, conversion rates, sell-through times and operational metrics - for product development, analytics, benchmarking, marketing claims and reporting. Aggregated data does not identify any individual guest, Organiser or event.
11.4 Cross-Organiser data is siloed
Guestii does not share or expose attendee data between separate Organisers. Each Organiser sees only data submitted in connection with their own events. Guestii does not sell, rent or trade personal data to third parties.
11.5 Encryption and retention
All guest data held by Guestii is encrypted at rest within the Guestii infrastructure. Where an Organiser offboards from the platform, their associated guest data is deleted from the active Guestii database within 30 days of offboarding, subject to any retention required by law (for example, financial records).
11.6 Export on offboarding
On reasonable request prior to offboarding, an Organiser may receive a one-time export of their attendee data in a standard format (for example, CSV).
12. Platform availability
We aim to provide a reliable service but:
- The platform may experience downtime
- Features may change
- Access may be interrupted
Guestii is not liable for operational disruptions.
13. Limitation of liability
To the maximum extent permitted by law:
Guestii is not liable for:
- Loss of revenue or profits
- Event outcomes
- Denied entry or venue decisions
- Payment issues handled by third parties
- An Organiser's use of guest or attendee data, including any external marketing, profiling, list sharing, onward disclosure or onward sale
- Privacy or spam-law claims, complaints or penalties arising from an Organiser's use of guest data outside the Guestii platform
- Indirect or consequential loss
Total liability is limited to the amount paid to Guestii in the previous 12 months.
14. Indemnity
You agree to indemnify Guestii against any claim, fine, penalty, complaint, loss or expense arising from:
- Your use of the platform
- Your events or promotions
- Your use of guest or attendee data, including external marketing, alleged breaches of privacy or spam laws, or unsolicited communications
- Your breach of these Terms
15. Third party services
Guestii integrates with third-party services including:
- Square
Guestii is not responsible for third-party systems.
16. Termination
We may suspend or terminate access if:
- These Terms are breached
- The platform is misused
- Required for legal or operational reasons
You may stop using the platform at any time.
17. Changes to Terms
We may update these Terms from time to time.
Continued use of the platform constitutes acceptance of updated Terms.
18. Governing law
These Terms are governed by the laws of Victoria, Australia.
